Il y a des fronti\u00e8res qui se ferment sans crier gare, pas de sir\u00e8ne, pas de d\u00e9claration de guerre, juste une porte qui claque. \u00ab Entry denied \u00bb. Soudain, le visa devient une arme diplomatique redoutable.\u00a0<\/span><\/p>\n

Cette semaine, Washington a d\u00e9cid\u00e9 de s\u2019en prendre \u00e0 l\u2019Europe. Non pas sur un champ de bataille, mais sur un terrain intangible : celui des plateformes, des r\u00e8gles, des algorithmes et de l\u2019empire num\u00e9rique. Les \u00c9tats-Unis ont d\u00e9clar\u00e9 des restrictions de visas ciblant cinq personnalit\u00e9s europ\u00e9ennes, compromises dans la lutte contre la d\u00e9sinformation et la r\u00e9gulation des grandes plateformes. Parmi elles, se trouve Thierry Breton, un Fran\u00e7ais et ancien commissaire europ\u00e9en, figure des grandes r\u00e8gles num\u00e9riques de l\u2019Union Europ\u00e9enne.\u00a0<\/span><\/p>\n

Le fondement am\u00e9ricain (ou l\u2019argumentaire) ? Ces personnalit\u00e9s europ\u00e9ennes ont \u00e9t\u00e9 accus\u00e9es de faire pression sur des entreprises technologiques am\u00e9ricaines tout en restreignant des opinions, au nom de la lutte contre les contenus d\u00e9l\u00e9t\u00e8res. En clair : l\u2019Europe r\u00e9gule, les \u00c9tats-Unis crient \u00e0 la censure. Prises entre ces deux entit\u00e9s, les plateformes respirent ou suffoquent selon le droit qui les encadre.\u00a0<\/span><\/p>\n

Ce qui \u00e9merveille, c\u2019est la mise en sc\u00e8ne. L\u2019Union europ\u00e9enne pense \u00e9crire les r\u00e8gles du jeu, le Digital Services Act\u00a0 (DSA) et Washington contre-attaque comme pour prot\u00e9ger un territoire sacr\u00e9. Comme si r\u00e9guler une plateforme revenait \u00e0 poser les mains sur la Constitution. Comme si l\u2019Europe n\u2019\u00e9tait plus un march\u00e9, mais une extinction de droit des Etats-Unis voire une menace culturelle.\u00a0<\/span><\/p>\n

C\u00f4t\u00e9 europ\u00e9en, la r\u00e9action est \u00e0 la hauteur de l\u2019affront : condamnations, d\u00e9nonciation d\u2019une mesure d\u2019intimidation, le rappel que l\u2019Union europ\u00e9enne est un march\u00e9 b\u00e2ti sur des r\u00e8gles et qu\u2019elle revendique le droit de r\u00e9guler selon ses valeurs d\u00e9mocratiques. La France, elle aussi, a critiqu\u00e9 cette d\u00e9cision.\u00a0<\/span><\/p>\n

Alors oui, on peut appeler \u00e7a un \u201cbras de fer\u201d. Je peux aussi y voir autre chose : une bataille pour d\u00e9terminer, qui demain, d\u00e9cidera de ce qui est acceptable ou non en ligne. Qui fixe les limites ? L\u2019\u00c9tat ? Le march\u00e9 ? Une entreprise californienne ? Une commission europ\u00e9enne ? Et le point culminant : \u00e0 qui profite ce flou ?\u00a0<\/span><\/p>\n

Parce qu\u2019au fond, ce n\u2019est pas uniquement Thierry Breton qui est vis\u00e9 en fermant les fronti\u00e8res \u00e9tasuniennes. C\u2019est l\u2019id\u00e9e m\u00eame qu\u2019un continent puisse dire aux g\u00e9ants du num\u00e9rique : \u00ab Vous jouez chez nous, vous respectez nos r\u00e8gles \u00bb qui incommode.\u00a0<\/span><\/p>\n

Et si un visa peut servir \u00e0 \u00e9touffer une r\u00e9gulation, c\u2019est que le num\u00e9rique n\u2019est plus un secteur : c\u2019est une puissance.<\/span><\/p>\n<\/figure>\n
